Welcome to nicezero. By accessing or ordering from our website, you agree to these Terms of Service (TOS). If you do not agree to these terms, please do not use the website.

1. Parties & Application

  1. These TOS govern the sale of goods by nicezero (referred to as “we”, “us”, “our”) to you (referred to as “you”, “customer”, “consumer”).

  2. These TOS apply whenever you access or order from our website, regardless of the device used.

2. Compliance with Applicable Law

  1. Where you are located in Australia, our sales to you are subject to the mandatory rights and protections under the Australian Consumer Law (ACL). We do not and cannot exclude or limit those rights. 

  2. Where you are located in New Zealand, our sales are subject to the protections under the Fair Trading Act 1986 (NZ) and the relevant consumer protections in New Zealand. 

  3. Nothing in these TOS is intended to override or diminish your legal rights under those laws.

3. Ordering, Pricing & Payment

  1. All orders are subject to product availability and acceptance by us.

  2. Prices shown on the site are in AUD (unless otherwise stated) and include any applicable Australian tax (e.g. GST) for Australian customers. For international or New Zealand customers, any additional duties, tariffs, or taxes may apply and are your responsibility.

  3. We reserve the right to correct errors (including in pricing or product descriptions) even after you have submitted an order, or to cancel orders if errors are discovered — in which case we will inform you as soon as reasonably possible.

4. Product Descriptions & Accuracy

  1. We endeavour to provide accurate product descriptions, images, sizes and colours. However, slight variations may occur (for example due to lighting, display settings, materials, or manufacturing).

  2. If a product you receive differs significantly from its description, you may be entitled to a remedy under consumer law (see section on Consumer Guarantees).

5. Intellectual Property

  1. All content on the website — including images, text, logos, designs, and other material — is owned or licensed by nicezero. You must not copy, reproduce, distribute, modify, or create derivative works from our content without prior written consent.

  2. You may use the products for their intended purpose only; you do not gain any additional intellectual property rights over images, designs or trademarks by purchasing products.

6. Limitation of Liability & Disclaimers

  1. To the full extent permitted by law, we are not liable for indirect, incidental, special or consequential damages arising from your use of our website or products (including but not limited to lost profits, lost data, or loss of goodwill).

  2. Nothing in these TOS limits or excludes our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability which cannot be excluded under applicable consumer protection law.

  3. We make no warranty (express or implied) beyond the consumer guarantees required by law.

7. Privacy & Data

Your privacy is important. Our use of your personal information is governed by our separate Privacy Policy [link to privacy policy]. By using the website or ordering from us, you consent to that policy.

8. Changes to Terms

We may revise these Terms of Service at any time. The “Last updated” date at the top will indicate when changes were made. Your continued use of the website after those changes means you accept the new TOS.

9. Governing Law & Jurisdiction

  1. If you are in Australia, these TOS are governed by the laws of the state or territory in which our business is registered, together with the ACL.

  2. If you are in New Zealand (or goods are shipped to New Zealand), the terms are also subject to New Zealand law (including the Fair Trading Act).

  3. Disputes will be resolved in the relevant courts or tribunals of the applicable jurisdiction.
